On January 16, 2024, the Cámara Nacional de la Industria Cinematográfica («Canacine» by its acronym in Spanish) entered into a Collaboration Agreement with the Ministry of Labor and Social Security («STPS«), to promote the dignified employment of workers in the sector (the «Agreement«)
The Agreement addresses two fundamental aspects:
I. Provide training to the union members in labor matters;
II. Generate guidelines for the adequate supervision and verification of compliance with labor obligations.
As a result of the foregoing, we expect a greater and stricter activity on the part of the labor authorities in order to identify potential non-compliance with the labor provisions in force, not only focused on the hiring of workers and subcontracting of specialized services, but in general on each of the obligations of those who assume an employer’s role.
It is important to mention that the review carried out by the labor authority may include the exercise of any of the powers conferred to it, among others, from the verification of adequate labor conditions, compliance with NOMs, establishment of joint commissions by law, labor regulations, regulation in terms of social security, payment of contributions or worker-employer fees, to collective relations in accordance with the new provisions on the matter.
